Liability & Guest Acknowledgment

1. Acknowledgment of Participation

By submitting a booking request or participating in any service coordinated by Tropical Haven, guests acknowledge that they understand and accept the nature of the activities involved.


2. Assumption of Risk

Guests understand that certain activities, including but not limited to marine excursions, boat trips, island tours and outdoor experiences, involve inherent risks.

Participation in all activities is voluntary and undertaken at the guest’s own risk. Guests are responsible for ensuring that they are physically and medically fit to participate in the selected services.


3. Dolphin Sightings & Nature-Based Activities

Guests acknowledge that dolphin sightings and other wildlife encounters depend entirely on natural conditions and cannot be guaranteed.

No refunds, compensation or claims shall be made on the basis of wildlife sightings not occurring.


4. Supplier-Operated Services

All services are operated by independent third-party suppliers.

Tropical Haven acts solely as a coordinator and shall not be held responsible for the actions, omissions, safety standards or operational decisions of suppliers.


5. Liability Limitation

To the maximum extent permitted by law, Tropical Haven shall not be liable for injuries, accidents, losses, delays, cancellations or damages arising from participation in services, supplier operations, weather conditions or force majeure events.


6. Guest Responsibility

Guests are responsible for complying with supplier instructions, safety guidelines and applicable laws during all activities.

Failure to comply may result in refusal of service without refund, subject to supplier policy.


7. Photo & Video Consent

Guests acknowledge and agree that photos and/or videos may be taken during services for marketing and promotional purposes, including publication on websites, social media and marketing materials.

If a guest does not wish to appear in photos or videos, this must be communicated in writing via email prior to the service.


8. Acceptance of Terms

By proceeding with a booking request and/or participating in any service, guests confirm that they have read, understood and accepted this Liability & Guest Acknowledgment.
